Our Commitment to Your Privacy

Magnolia Therapy Center is required by law to maintain the privacy of your Protected Health Information (PHI), to provide you with this notice of our legal duties and privacy practices, and to follow the terms of this notice currently in effect.

How We May Use and Disclose Your Information

Treatment: We may use and disclose your PHI to provide treatment and coordinate care. For example, we may share information with other healthcare providers involved in your care with your consent.

Payment: We may use and disclose your PHI to obtain payment for services rendered, including submitting claims to your insurance carrier.

Healthcare Operations: We may use and disclose your PHI for quality improvement, training, and practice management purposes.

As Required by Law: We will disclose your PHI when required by federal, state, or local law, including mandatory reporting obligations under Florida law.

Mandatory Reporting: As required by Florida law, we are obligated to report suspected child abuse or neglect, abuse or neglect of vulnerable adults, and situations involving imminent danger to yourself or others.

Your Rights Regarding Your PHI

  • Right to Access: You have the right to inspect and obtain a copy of your health records. Requests are typically fulfilled within 30 days.
  • Right to Amend: You may request correction of information you believe is inaccurate or incomplete.
  • Right to an Accounting of Disclosures: You may request a list of disclosures we have made of your PHI.
  • Right to Request Restrictions: You may request restrictions on how we use or disclose your PHI, though we are not always required to agree.
  • Right to Confidential Communications: You may request that we communicate with you in a specific way or at a specific location.
  • Right to a Paper Copy: You may request a paper copy of this notice at any time.
  • Right to File a Complaint: You may file a complaint with us or with the Secretary of the U.S. Department of Health and Human Services if you believe your privacy rights have been violated. We will not retaliate against you for filing a complaint.

Psychotherapy Notes

Psychotherapy notes (process notes kept separately from your medical record) receive special protection under HIPAA and Florida law. These notes will not be disclosed without your written authorization except in very limited circumstances required by law.

Changes to This Notice

We reserve the right to change this Notice at any time. The revised notice will be effective for PHI we already hold as well as any new PHI created or received after the effective date.

Telehealth Informed Consent

Per Florida Statute §456.0501 and applicable telehealth regulations

Magnolia Therapy Center offers telehealth services — the delivery of mental health services via HIPAA-compliant video or phone technology — to clients located in Florida and Georgia. Before receiving telehealth services, clients are required to provide informed consent. The following outlines the nature, risks, and benefits of telehealth.

What Telehealth Involves

Telehealth sessions are conducted via HIPAA-compliant video conferencing through SessionsHealth. Sessions are conducted in real time and are equivalent in clinical content to in-person sessions. Sessions are never recorded without your explicit written consent.

Benefits

  • Access to care without travel, particularly for clients in rural or underserved areas
  • Flexibility for clients with demanding work schedules, including shift workers
  • Continuity of care during illness, weather events, or other disruptions

Risks and Limitations

  • Technology failures (internet outages, platform issues) may interrupt sessions
  • Confidentiality may be compromised if you are in a non-private location
  • Some clinical presentations may be better served by in-person care
  • Crisis intervention via telehealth has limitations — in a mental health emergency, you should contact 988, 911, or go to the nearest emergency room

Your Responsibilities

You are responsible for ensuring you are in a private location during telehealth sessions, that your device and internet connection are functioning, and that you are located within the state of Florida or Georgia (where your clinician is licensed) at the time of service.

Platform Security

Sessions are conducted through SessionsHealth, a HIPAA-compliant platform. A Business Associate Agreement (BAA) is in place with this platform. We use reasonable technical safeguards to protect your information; however, no electronic transmission is entirely without risk.

Emergency Protocol

Prior to beginning telehealth services, clients provide a local emergency contact and confirm their physical location. If a clinician believes a client is in imminent danger during a telehealth session, emergency services may be contacted at the client's location.

No Surprises Act — Good Faith Estimate

Effective January 1, 2022  ·  Per 45 CFR §149.610

Under the No Surprises Act (effective January 1, 2022), you have the right to receive a Good Faith Estimate of expected costs before beginning services, if you are uninsured or choose to pay out of pocket.

Your Rights

  • You have the right to receive a Good Faith Estimate in writing at least one business day before your appointment
  • You have the right to receive a Good Faith Estimate before scheduling if you request one
  • If your final bill exceeds the Good Faith Estimate by more than $400, you may dispute the bill
  • Make sure to save a copy of your Good Faith Estimate

What a Good Faith Estimate Includes

A Good Faith Estimate shows the cost of items and services reasonably expected for your care. It is based on information known at the time of the estimate and does not account for unexpected clinical needs that may arise during the course of treatment. The estimate is not a contract and does not require you to obtain the listed services.

Current Self-Pay Rates

  • Intake Assessment: $200 standard / $110 same-day self-pay rate
  • Individual Therapy Session (60 minutes): $150 standard / $110 same-day self-pay rate
  • Consultation Services: $110 per hour

Clients paying through insurance are subject to their plan's deductible, copay, and coinsurance amounts. We recommend verifying your benefits directly with your insurance carrier prior to your first appointment.
